How does FGTS work?

In principle, the FGTS is a right for Brazilian workers with a formal contract, where employers deposit 8% of their salary monthly.

Normally, the full withdrawal of the FGTS is allowed in specific situations, such as unfair dismissal, retirement, purchase of your own home, serious illnesses, or upon reaching the age of 70.

Choosing the birthday withdrawal, however, changes the availability of the full withdrawal in the event of dismissal, limiting access only to the termination fine.

Since 2019, the FGTS has started to offer a new withdrawal method for workers: the birthday withdrawal.

Basically, this option allows the redemption of a portion of the FGTS balance annually, in the worker’s birthday month or in the subsequent three months.

However, opting for the birthday withdrawal means renouncing the right to withdraw the full FGTS balance in the event of unfair dismissal, a change that raises several questions among workers.

How does the birthday withdrawal work?

In summary, the birthday withdrawal is a type of FGTS that allows the worker to annually withdraw a portion of their account balance in the month of their birthday.

Therefore, when opting for this modality, the worker waives the right to withdraw the full balance in the event of unfair dismissal, whilst maintaining the right to a 40% fine.

It is possible to choose the birthday withdrawal through Caixa Econômica Federal’s service channels, but reverting to the traditional withdrawal is only permitted after 25 months of the change.

Flexibility in FGTS

Furthermore, the option for a birthday withdrawal offers workers greater flexibility in accessing part of their funds, which can be useful for covering emergency expenses or making short-term plans.

However, it is crucial to be aware that, when choosing this modality, you lose the right to full withdrawal of the FGTS in situations of unfair dismissal.

The Minister of Labor, Luiz Marinho, began discussions about the possibility of allowing termination withdrawal even for those who opted for the birthday withdrawal, a proposal that seeks to balance the flexibility of this modality with the security of full withdrawal in the case of non-voluntary dismissal.

A bill by Senator Paulo Paim follows the same line, suggesting changes that could benefit workers in the future.
