However, article 267 of the CTB provides for the replacement of fines with warnings in cases of light or medium infractions, without recurrence within a period of one year.

This means that, in some situations, instead of a fine, you may receive a warning that does not generate points on your license or require payment.

How to free your driver’s license from fines

Furthermore, to request the conversion of a fine into a warning, some requirements must be met.

Firstly, the notice of assessment must be issued by a competent body, such as the DETRAN in your state.

You must access this agency’s service portal within the deadline to present your defense of the assessment.

How do traffic fines work?

In short, traffic fines in Brazil are classified into four categories, each with a specific value and associated points that are recorded on the CNH.

Light fines have a penalty of R$88.38 and carry 3 points on the driver’s license. Average fines result in 4 points and cost R$130.16.

Serious tickets have a value of R$ 195.23 and add 5 points to the driver’s license. Finally, very serious fines, the most serious, cost from R$293.47 and add 7 points to your license.

Can I transfer all fines to save my driving license?

Some traffic tickets are non-transferable, meaning that liability cannot be assigned to anyone other than the original offender.

This generally applies to infractions involving vehicle and traffic safety, such as driving under the influence of alcohol or drugs, refusing to take a breathalyzer test, and speeding at more than 50% of the legal limit.

In other words, in these situations, the driver who committed the infraction is directly responsible, regardless of who owns the vehicle.
